What is Section 889 Compliance?

Section 889 of the John S. McCain National Defense Authorization Act (NDAA) for Fiscal Year 2019 was enacted to protect U.S. national security by reducing the risk of foreign espionage and cyberattacks. It establishes a strict "Anti-Huawei Rule" that prohibits the federal government from working with companies that use or provide certain foreign telecommunications and video surveillance equipment.

The regulation is divided into two primary parts:

  • Part A (Prohibition on Procurement): Prohibits the government from purchasing any equipment or services that use "covered" telecommunications equipment from prohibited entities as a substantial component.

  • Part B (Prohibition on Contracting): Prohibits the government from entering into a contract with any entity that uses covered equipment or services in its own operations—even if that use is unrelated to a federal contract.

Our Official Representation

As of January 1, 2025, Veteran Industrial Suppliers LLC maintains an Active registration in the System for Award Management (SAM.gov) and is officially rated as COMPLIANT with Section 889 requirements.

In accordance with FAR 52.204-26 (c), we represent the following:

  • No Prohibited Products: We DO NOT provide covered telecommunications equipment or services to the Government as part of our offered products or services.

  • No Prohibited Use: After a reasonable inquiry, we have determined that we DO NOT use any covered telecommunications equipment, systems, or services in our daily business operations.
